Terms & Conditions

By using this website, you agree to the Privacy Policy and Terms & Conditions outlined below. Please read these terms carefully before using our site or services. The Terms & Conditions contained on this page are subject to change at any time. 

Thank you for visiting our website. The terms “we,” “us, “our,” and “provider” refer to Marisa Glaser and Marisa Glaser Creative. The terms “website” or “site” refer to www.marisaglasercreative.com. The terms “user,” “users,” “you,” “your,” and “client” refer to website visitors and customers, whether personal or business entities, and include, but are not limited to, business entities’ agents, representatives, contractors, affiliates, and employees. 

These Terms & Conditions (“Terms”) apply to all site users, customers, and other visitors of our website. By using our website and/or Services, you hereby agree to have read and acknowledged the Terms & Conditions and the Privacy Policy set forth herein (collectively referred to as “Agreement”), without modification. 


Terms & Conditions

Cancellation. If the Client cancels the Services, the Provider keeps the non-refundable retainer as a cancellation fee. This retainer may be credited towards a future Service if the Client contacts the Provider at least 48 hours prior to the photo shoot and reschedules at an agreeable date and time. If the Client has paid the Total Cost in full and cancels the Services but chooses not to reschedule the photo shoot, the Provider will retain the retainer as a cancellation fee and refund the remaining balance of the Total Cost.

Rain or Inclement Weather. If the forecast predicts more than a 50% chance of rain or other weather not conducive to outdoor photos during the time of our photo shoot, Provider will reach out to Client to see if Client would like to proceed as scheduled, move to a different location, or reschedule for an agreeable date and time within 60 days of our original date.

Retainers. The first payment is a non-refundable retainer, due at the time of signing. At a minimum, Client agrees that the retainer fee fairly compensates Provider for committing to provide the Services and turning down other potential projects/clients during the agreed timeframe.

Price Adjustments. Total Cost is the estimated quote given at time of booking. Should additional photos, formats, hours, or rounds of editing ("Additional Services") be requested outside of the Services, additional invoices will be sent. Client will be notified of any additional charges before any Additional Services are performed.

Cancellation Policy, Payments, and Refunds

Maximum Damages. Client agrees that the maximum amount of damages he or she is entitled to in any claim relating to this Agreement or Services provided in this Agreement are not to exceed the Total Cost of Services provided by Provider.

Style. Client has spent a satisfactory amount of time reviewing Provider's work and has a reasonable expectation that Provider will perform the Services in a similar manner and style unless otherwise specified in this Agreement.

Loss of Product. In the event that any or all product(s) are lost, such as damage to or loss of a component of the product necessary for final delivery, Provider shall refund Client a prorated portion of the Total Cost based on the amount of Services that were completed/provided against the amount of Services that were agreed to be completed/provided.
 
Failure to Perform Services. In the event Provider cannot or will not perform its obligations in any or all parts of this Agreement, it (or a responsible party) will:
  • Immediately give Notice to Client and attempt to find another competent professional to take its place with the mutual agreement of Client;
  • If another competent professional is not available or Client does not agree to transfer of obligations to said alternate professional, Provider will issue a refund or credit based on a reasonably accurate percentage of services rendered; and
  • Excuse Client of any further performance and/or payment obligations in this Agreement.


Limit of Liability

All images, website copy, texts, graphics, and trademarks are property of Marisa Glaser and Marisa Glaser Creative, unless another party is attributed. By visiting our website you agree that:
  • You will not copy, duplicate, download, alter, or steal our website content
  • You will not imply that our website or its content are yours or were created by you

Permitted Uses of Product(s). Provider grants to Client an exclusive, perpetual license of image(s) produced with and for Client for digital commercial use. Digital commercial use includes, but is not limited to, use within the following contexts:
  • In posts on Client’s social media pages or profiles; or
  • In website usage for e-commerce sale of products; or
  • In personal communications, such as a virtual newsletter or email.

For print usage such as banners, billboards, magazines, business cards, retail signage, and out-of-home advertising, an Extended License & Print Release will need to be negotiated prior to use.

Copyright. Client acknowledges and agrees that product is the property of the Provider and Provider may use it to promote its business.
